Dear User, You are currently browsing and using the website of Lobby 99 Ltd. (Public Benefit Corporation) (the “Website”; the “Lobby”). Browsing and using the website are subject solely to the Website’s Terms of Use and Privacy Policy, which constitutes a binding legal agreement (the “Terms”); therefore, we ask that you read them carefully.

By browsing and using the website, you declare that: (A) You have read the Terms and agree to their conditions. (B) You are an adult (18 or older) with the legal capacity to enter into an agreement under the conditions of these Terms

The Website and the Terms

1. The Website is intended to serve as a platform for presenting the Lobby's activities; involving Lobby members in its operations; and soliciting donations.
2. The Website is the sole property of the Lobby; the Lobby holds full and exclusive discretion regarding the maintenance, management, and updating of the Website.
3. The Lobby reserves the right to amend the Website and the Terms from time to time, at its full and exclusive discretion and without prior notice. This includes, among other things, updating the Terms, determining methods of access and use of the Website, requiring the submission of personal details to perform actions, blocking/canceling any end-user action, and changing any technical or content component of the Website, etc.
4. Anyone browsing and using the Website (the "End-User") does so on an "AS IS" and "AS AVAILABLE" basis; any subsequent browsing and use constitutes renewed consent to the Terms.
5. The Website is not intended to provide advice to the End-User regarding their private affairs, and the information appearing on the Website should not be relied upon for making decisions regarding private matters.

Browsing and Use of the Website

1. The Lobby makes reasonable efforts to maintain, manage, and update the Website in accordance with the law, including with respect to data security and privacy protection; however, it shall not bear any liability for technical malfunctions or faults beyond its control, nor shall it provide technical support for browsing and using the Website.
2. Browsing and using the Website are at the End-User’s sole discretion and responsibility; for legal purposes only; in accordance with the Terms; and for personal use only.
3. Browsing and use do not grant the End-User any rights regarding the Website and/or the information appearing therein. The End-User is prohibited from making any use of the Website/information that is not in accordance with the law and/or the Terms, and/or any harassing/offensive use, whether partial or full, temporary or permanent, unless prior written consent has been obtained from the Lobby.
4. The End-User shall not act in violation of the law, the Terms, or any other condition determined by the Lobby; she shall not knowingly jeopardize the Website, the information on the Website, or its data security. The Lobby shall not be liable for any action taken by the End-User, particularly any action in violation of the law.
5. The Lobby reserves the right to block or restrict the End-User’s browsing and use of the Website and/or to reject her membership/donation and/or to remove any content on behalf of the End-User, all at its sole discretion, without any obligation to provide reasoning or prior notice; the Lobby is entitled to take legal proceedings against an End-User who acts in violation of the law or the Terms.
6. Some information on the Website is provided by third parties or refers to them (via links to other websites). The Lobby bears no responsibility for such information, including its legality, reliability, completeness, usefulness, etc.; no claim shall be heard against the Lobby regarding any damage or loss caused by any aspect relating to third-party information, including the functionality of links appearing on the Website.
7. The Lobby shall be exempt from all liability, including any obligation for compensation, for any damage or loss caused, or that may be caused, as a result of browsing and using the Website, including any malfunction of the Website, the use of equipment/software/information for the purpose of accessing the Website, loss or corruption of data, actions by an End-User or any other third party in violation of the law/Terms, the submission of false or incomplete details by the End-User, and links to other websites.

Uploading Content and Providing Information on the Website

1. Lobby 99 may permit the End User to upload content to or through the Website and/or require the submission of personal information for the purpose of carrying out actions via the Website.
2. The End User is under no legal obligation to upload content or provide personal information. Any such submission shall be made voluntarily and with the understanding and consent that Lobby 99 may, at its sole discretion, retain such information in its databases and make any lawful use thereof. Lobby 99 may also contact the End User from time to time via text messages and/or email, unless the End User expressly indicates that she does not wish to receive such communications.
3. For the purpose of any dispute between the parties, the decisive date shall be the date on which the content and/or the End User’s personal details were entered and recorded in Lobby 99’s systems.
4. The End User shall not upload content to the Website and/or provide personal information that does not belong to her, that violates any applicable law, or that is false, incomplete, misleading, offensive, or harassing. Lobby 99 shall not be responsible for any information uploaded by the End User. The End User shall bear full and sole responsibility for such information, including for any damage or loss caused, or that may be caused, to Lobby 99, the Website, or any third party
5. For the avoidance of doubt, knowingly submitting or uploading false information constitutes a criminal offense.

Donations and Cancellation

1. Lobby 99 permits an End User to join as a member and make a donation only if the End User is at least 18 years of age, provides accurate and complete personal details, and possesses a valid payment method. All donations shall be used exclusively to advance Lobby 99’s publicly stated public-interest objectives.
2. The donation shall be made באמצעות the End User’s chosen payment method, provided that such payment method is supported by Lobby 99 and processed through Cardcom’s secure clearing system, which complies with the international PCI DSS standard. The donation amount includes VAT and is recognized for tax purposes under Section 46 of the Israeli Income Tax Ordinance. A donation will only be completed upon receiving authorization from the relevant payment provider and the clearing company. Upon completion of the donation, the End User will receive a confirmation email at the address provided on the Website.
3. The End User is responsible for verifying that her recurring or one-time donation reflects the intended amount. Lobby 99 shall bear no liability and will not issue refunds for past donations in the event of an error in the donation amount.
4. Lobby 99 shall bear no liability and shall not issue any refund for a past donation made by mistake, whether in full or in part.
5. Lobby 99 implements reasonable security measures to protect the confidentiality of the End User’s personal and payment information. Nevertheless, Lobby 99 shall not be responsible for any damage or loss resulting from circumstances beyond its reasonable control, including unauthorized access to or use of such information.

7. A cancellation notice will be processed within three (3) days from the date it is received in Lobby 99’s email system. The cancellation shall apply only to future donations and shall not apply to donations that have already been received and completed, which shall not be refunded under any circumstances. Any fees or related charges incurred in connection with the cancellation and imposed by third parties shall be borne in full by the End User.
8. Lobby 99 shall bear no responsibility for any cancellation request that is not duly processed as a result of inaccurate or incomplete details provided by the End User, or due to technical failures or other circumstances beyond its reasonable control.

Intellectual Property

1. All intellectual property rights in the Website and the information appearing therein—including content, design, presentation, or otherwise, as well as technical information—belong exclusively to the Lobby (or to third parties who have authorized the Lobby to use such information). The name "Lobby 99 Ltd. (Public Benefit Corporation)" and any other trademarks or symbols of the Lobby are also part of the Lobby's property, and all rights concerning them are reserved solely to the Lobby.
2. It is prohibited to make any unauthorized or unlawful use of the information that may violate intellectual property laws (including copyrights, trademarks, privacy protection, etc.). This includes modifying, copying, selling, distributing, broadcasting, publishing, and/or sending advertising content, and/or exposing the Website to software/files that may cause technical or other malfunctions, and/or preventing/restricting a third party from browsing and using the Website, or any other unlawful use of the information. Liability for such unauthorized use and for any damage/loss caused, or that may be caused as a result, shall rest solely with the user (whether the End-User or any other third party).
3. Browsing and using the Website do not grant the End-User any right to make any offensive or harassing use of the Website and the information appearing therein, whether partial or full, temporary or permanent; the End-User shall bear exclusive responsibility for doing so

Miscellaneous

1. These Terms shall supersede any prior or contemporaneous agreement, representation, or understanding made on behalf of Lobby 99, unless expressly stated in writing that such agreement overrides these Terms.
2. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to render it valid and enforceable, consistent with its original intent.
3. In the event of any dispute regarding these Terms, the End User and/or any third party agrees to first contact Lobby 99 in an effort to resolve the matter amicably and confidentially. If the dispute cannot be resolved through such efforts, the parties shall submit the dispute to confidential mediation. Only if mediation fails may the parties proceed to the competent court of jurisdiction.
4. These Terms of Use and the Privacy Policy shall be governed exclusively by the laws of the State of Israel. Exclusive jurisdiction shall be vested in the competent courts of Tel Aviv, Israel.
